1. Introduction

1.1 These terms and conditions govern the use of the Property Marketing Floor Plan services provided by FloorScape, a business registered in Queensland, Australia, as FloorScape Pty Ltd with the ABN: 94 660 137 217.

1.2 By using our services, you agree to be bound by these terms and conditions. If you do not agree with these terms and conditions, please do not use our services.

2. Services

2.1 FloorScape provides Property Marketing Floor Plan services to its clients. The services include creating and delivering digital marketing floor plans of properties.

2.2 FloorScape measures the property onsite or the client provides us with architectural plans to create the floor plan.

2.3 FloorScape reserves the right to modify or discontinue any aspect of the services at any time without notice or liability.

2.4 FloorScape reserves the right to charge a cancellation fee, equivalent to half the product cost, in the event that an onsite measure is canceled less than 24 hours before the scheduled booking.

3. Client Obligations

3.1 The client is responsible for providing accurate information about the property to be marketed, including requests for alterations and/or verbal or written specifications.

3.2 The client must provide FloorScape with access to the property or accurate and up-to-date architectural plans to create the product. The property must be safely inhabitable and safe for onsite access.

3.3 The client must ensure that they have the necessary rights and permissions to allow FloorScape to use the property information for marketing purposes.

4. Fees and Payment

4.1 FloorScape's fees for its services are outlined on its price list.

4.2 The client agrees to pay the fees in full and within 14 days of delivery of the final product.

4.3 FloorScape reserves the right to suspend or terminate services if fees are not paid in full and within 14 days of delivery of the final product.

4.4 FloorScape reserves the right to charge late fees of $2.00 AUD per calendar day, of which the sum is overdue if fees are not paid in full and within 14 days of delivery of the final product.

4.5 The client is responsible for all fees associated with collections activity undertaken by FloorScape in the event of non-payment.

4.6 The liable party is the business or individual that the person making the booking represents. If the person scheduling the work is acting as an agent or employee of a business, that business is responsible for payment. If they are not representing a business, they are personally liable. This responsibility applies regardless of any internal agreements between the scheduler and the party they represent.

5. Intellectual Property & Copyright

5.1 FloorScape retains all intellectual property rights in the floor plans created for the client.

5.2 The client is granted a non-exclusive, non-transferable, revocable license to use the floor plans for marketing purposes only.

5.3 The client must not use the floor plans for any other purpose without the prior written consent of FloorScape.

6. Limitation of Liability

6.1 FloorScape is not liable for any loss, damage, or expense arising from the use of its services, including but not limited to errors, omissions, or inaccuracies in the floor plans.

6.2 The client is responsible for verifying the accuracy and completeness of the floor plans before using them for marketing purposes.

7. Governing Law and Jurisdiction

7.1 These terms and conditions are governed by the laws of the state or territory of which the booking was made, as dictated by the property address. If the property is not located in Australia, then the default jurisdiction is Queensland.

7.2 Any disputes arising from these terms and conditions will be subject to the exclusive jurisdiction of the courts of the state or territory of which the booking was made, as dictated by the property address. If the property is not located in Australia, then the default jurisdiction is Queensland.

8. Entire Agreement

8.1 These terms and conditions constitute the entire agreement between FloorScape and the client.

8.2 These terms and conditions supersede all prior agreements, negotiations, and understandings, whether oral or written, between FloorScape and the client.
